GENERAL TERMS OF CONTRACTING

Introduction

This contractual document governs the General Terms and Conditions of purchasing products (hereinafter, the “Terms”) through the website mercapixels.com, owned by JUSER GLOBAL SOLUTIONS SL under the trade name MERCA PIXELS, hereinafter the PROVIDER, whose contact details are also listed in the Legal Notice of this website.

These Terms will remain published on the website for the USER to reproduce and save as confirmation of the contract. They may be modified at any time by JUSER GLOBAL SOLUTIONS SL. It is the responsibility of the USER to read them periodically, as the Terms in effect at the time of placing an order will apply. JUSER GLOBAL SOLUTIONS SLwill archive the electronic document formalizing the purchase and make it available to the USER upon request.

Contracts are not subject to any formal requirements, except in cases expressly indicated in the Civil and Commercial Codes or in this or other special laws.

By accepting this document, the USER acknowledges that they:

Have read, understood, and comprehend its contents.
Are legally capable of entering into contracts and assume all obligations set forth herein.

These Terms have an indefinite validity period and apply to all purchases made through the PROVIDER’s website.

The PROVIDER informs that it is aware of and responsible for the applicable laws in the countries to which it ships products and reserves the right to unilaterally modify the Terms without affecting goods or promotions purchased prior to the modification.

Identity of the Contracting Parties

On one side, the PROVIDER of the products purchased by the USER is JUSER GLOBAL SOLUTIONS SL, with registered office at Carrer Mestra Isabel López Evole 10, 46970 Alaquàs, Valencia, NIF B75569590, and customer service phone 644356216.

On the other side, the USER, registered on the website with a username and password, is fully responsible for their use and security and for the accuracy of the personal data provided to the PROVIDER.

Purpose of the Contract

This contract regulates the sales relationship between the PROVIDER and the USER from the moment the USER accepts the corresponding checkbox during the online purchase process.

The sales contract involves delivering a specific product in exchange for a determined price publicly displayed on the website.

Correction of Data

If the USER identifies errors in data published on the website or in documents generated by the contractual relationship, they may notify info@grupojuser.com so that JUSER GLOBAL SOLUTIONS SL can correct them as soon as possible.

The USER can keep their data updated by accessing their user account.

Contracting Procedure

The USER must be of legal age or emancipated and register on the website by creating a user account. The USER must freely and voluntarily provide the required personal data, which will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), as detailed in the website’s Legal Notice and Privacy Policy.

The USER agrees to use the account responsibly, not share credentials with third parties, and notify the PROVIDER of any loss, theft, or unauthorized access so that the account can be blocked immediately.

Once the account is created, the contracting procedure will follow the steps required by Article 27 of Law 34/2002 (LSSICE):

1. General Terms of Contracting

Except for specific written agreements, placing an order constitutes acceptance of these Terms. No stipulation by the USER may differ from the PROVIDER’s Terms unless expressly accepted in writing by the PROVIDER.

2. Shipping and Delivery of Orders

No order will be shipped until payment has been verified.
Shipments will usually be made via express courier (CTT EXPRESS, GLS, RUNNER PALLETWAYS, XPO, etc.) to the USER-designated address. Shipment occurs once availability is confirmed and payment is verified.

Delivery times range from 2 to 20 business days, depending on the product, destination, and payment method. Estimated shipping and delivery dates are provided before order confirmation.

Non-fulfillment of Distance Contract

The PROVIDER is not responsible for delivery failures caused by incorrect, false, or incomplete data provided by the USER.

Delivery is considered complete when the carrier provides the products to the USER, who or their delegate signs the delivery receipt.

The PROVIDER is liable for any non-conformity present at delivery. The USER may request correction, price reduction, or contract termination. The USER may also claim damages where applicable.

The USER can withhold payment until the PROVIDER fulfills its contractual obligations.

It is the USER’s responsibility to verify products upon receipt and note any discrepancies on the delivery document.

For digital downloads, the PROVIDER will provide instructions for accessing the download.

3. Right of Withdrawal

The USER has 14 calendar days from product receipt or service contract conclusion to exercise withdrawal under Article 102 of Royal Legislative Decree 1/2007 (RDL 1/2007).

If the PROVIDER fails to inform the USER about withdrawal rights, the period extends 12 months beyond the initial 14 days.

Withdrawal does not apply to contracts listed in Article 103 of RDL 1/2007.

Returns must be communicated to the PROVIDER using the return form or via info@mercapixels.com, including the invoice or order number.

If the return is not in the original packaging, the PROVIDER may charge the USER, informing them in advance.

The USER must send the product to:

4. Complaints and Online Dispute Resolution

Online Dispute Resolution (ODR)

Per Article 14.1 of Regulation (EU) 524/2013, the EU provides a free platform for resolving disputes online with the help of a neutral third-party mediator.

5. Force Majeure

Neither party is liable for failures due to force majeure. Obligations are suspended until the force majeure event ends.

6. Competence

The USER may not assign or transfer rights or obligations under the sale.

If any provision is deemed invalid, the remainder remains enforceable.

The USER declares to have read, understood, and accepted these Terms.

7. General Offer Conditions

All sales and deliveries are subject to these Terms. Modifications require written consent from the PROVIDER.

8. Price and Validity of Offer

Prices include VAT or other applicable taxes. Shipping, handling, or additional services are not included unless explicitly stated.

Prices are in EURO and may vary in real-time.

Invoices are issued in the USER’s name or company provided, sent via email with order confirmation, downloadable as PDF from the account panel.

9. Shipping Costs

Shipping is not included unless stated. Costs are calculated based on weight and delivery address.

10. Payment Methods, Charges, and Discounts

Security Measures

The website uses SSL, firewalls, access controls, and cryptography to prevent unauthorized access. The PROVIDER will not allow illegal transactions per credit card brands or banks.

11. Purchase Process

Products can be added to the cart, reviewed, and purchased. The cart is non-binding and only simulates a budget.

12. Dissociation, Suspension, or Termination of Contract

Illegal or unenforceable provisions are severable.

The PROVIDER may suspend or terminate USER access if obligations are breached.

Exercise of rights here does not affect other rights or remedies.

13. Warranties and Returns

Warranties comply with RDL 1/2007, Title on “Guarantees and After-Sales Services.”

14. Governing Law and Jurisdiction

Spanish law governs matters not expressly stated. Disputes fall under the courts of the USER’s domicile, place of obligation, or property location if immovable.

Consumer Goods Law

New consumer goods: 3-year warranty
Second-hand goods: 1-year warranty
First 6 months assume factory defect; seller bears repair costs.
Warranty suspension during repair.

Commercial warranty may exceed legal warranty; terms must be clear.

Additional Clauses

Custom-made products: 18–25 business days manufacturing time.
Shipping outside mainland Spain (e.g., Balearic Islands) is at the customer’s risk; return shipping costs for repairs within two years borne by the customer.
Inspect packages in presence of courier; note any damage.
No withdrawal once production has started for personalized items.
Bank transfer payments must be made within 48h; otherwise, order may be canceled.
After 6 months, shipping for warranty repairs is the customer’s responsibility; repair costs are covered under the two-year warranty.
Joysticks have 8 directions; some games (like Pacman) may work better with 4 directions—users must adapt.
Unjustified returns (change of mind) require the customer to cover shipping both ways.
